Welcome, everyone! At Moms Manager Vancouver, we celebrate your pregnancy and forthcoming birth. As a mother in your family, we are dedicated to helping you become a loving and healthy mother to your precious child.

Terms of Use and Refund Policy

Article 1 (Purpose) These terms govern the rights, obligations, and responsibilities of users utilizing the internet and home-visit postpartum care services (hereafter referred to as 'services') provided by "Moms Manager."

Article 2 (Definitions)
⦁ "Moms Manager" refers to the business operating the home-visit postpartum care service, equipped with related information communication facilities and premises.
⦁ "User" means a member who receives services provided by Moms Manager in accordance with these terms.
⦁ "Member" refers to an individual who has provided personal information to apply for counseling with Moms Manager, continuously receives information from Moms Manager, and can continuously use the services provided by Moms Manager.

Article 3 (Service Content and Scope)
⦁ The postpartum caregiver's primary tasks involve aiding in the mother's recovery and newborn care, with minor household chores as secondary tasks. Services to family members other than the husband may incur additional fees.
⦁ The range of postpartum caregiver services includes cleaning (mother/baby room, kitchen), laundry (separating and washing newborn and family clothes), and meal preparation (focused on the mother, with additional amounts for family), among others defined in the Moms Manager program. Services unrelated to postpartum care are excluded unless otherwise agreed upon.
⦁ Moms Manager provides the following internet services through its website: guidance on home-visit postpartum care services and online applications, online customer counseling.

Article 4 (Reservation)
⦁ Service applications can be made via internet or phone. A reservation is completed once the user has paid the designated deposit to Moms Manager's account within 3 days of application and informed Moms Manager of the payment for confirmation.
⦁ The reservation deposit can be paid in cash or by bank transfer.
⦁ Upon confirmation of the reservation deposit payment, Moms Manager will notify the user via email, phone, or text message.

Article 5 (Formation of Service Contract)
⦁ Moms Manager accepts service reservations unless they fall under the exclusions listed, such as false information, unauthorized use of another's identity, non-payment of the reservation fee within 3 days of application, falsification of counseling/loan documents, or failure to fulfill the duty to inform Moms Manager.
⦁ The service contract is considered established when Moms Manager sends a deposit confirmation notification to the user, with immediate notification and refund of the reservation fee in case of non-acceptance.

Article 6 (Service Reservation Changes) Should there be changes in the delivery date, surgery date, or service duration, the user or their family must notify Moms Manager at least 10 days before the initial reservation. Negligence in this regard that leads to service disruptions is the user's responsibility.

Article 7 (Service Fees and Payment)
⦁ Service fees are based on the rates set by Moms Manager and are agreed upon between Moms Manager and the user at the time of reservation.
⦁ The reservation fee is paid to the local Moms Manager account before the service starts, separate from grocery shopping costs.
⦁ The balance is paid into the account provided on the first day of service.

Article 8 (Service Duration and Extension)
⦁ The minimum service duration is two weeks, provided on a weekly basis.
⦁ Fees for extended services are added to the initial contract period, with additional charges applicable after four weeks based on the extended duration.
⦁ Changes in service type (commuting ↔ live-in) are settled by paying the due amount up to the desired change date, then paying for the new service type and duration.
⦁ Changing from commuting to live-in services or extending the duration may result in a change of the caregiver or discontinuation of service.

Article 9 (Rights and Duties of Users)
⦁ Users may consult about postpartum care via phone or visit when necessary.
⦁ Users can request a change of caregiver or termination of service under certain conditions, requiring about 5 days for replacement:
⦁ Failure to follow the service program set by Moms Manager without a valid reason.
⦁ Unsatisfactory service due to insincerity, or if hygiene and cleanliness are not maintained.
⦁ If the caregiver attempts or insists on performing medical acts.
⦁ Emotional conflicts with the caregiver that prevent satisfactory postpartum care.
⦁ Other circumstances where the caregiver does not fit well with the user's needs.
⦁ Caregivers are there to assist with postpartum care and are not to perform medical acts. Moms Manager is not responsible for accidents involving the mother or newborn requiring special medical attention not previously communicated.
⦁ Users are responsible for safely storing valuables or fragile items to prevent misunderstandings or losses. Moms Manager and caregivers are not liable for losses.
⦁ Users must inform Moms Manager and the caregiver about any health conditions or symptoms of the mother and newborn, including any dietary restrictions.
⦁ The final decision on whether the newborn requires hospital examination lies with the user, with the caregiver able to accompany and support.
⦁ Posting or publishing obscene or violent messages, images, voices, or other information against public morals on Moms Manager's website is prohibited.

Article 10 (Rights and Duties of Moms Manager)
⦁ Moms Manager may change the caregiver or terminate the service under certain conditions:
⦁ If the caregiver faces personal insults or threats to their safety from the user or user's family.
⦁ If the user or family refuses postpartum care or responds insincerely, making satisfactory care impossible.
⦁ In case of temporary illness of the caregiver or significant personal events.
⦁ If excessive household tasks beyond the scope of postpartum care are demanded, making proper service delivery difficult.
⦁ Moms Manager commits to not engaging in illegal or immoral activities and to providing continuous, stable service in accordance with these terms.
⦁ Moms Manager must ensure the security of users' personal information.
⦁ Moms Manager will not send unsolicited commercial emails to users.

Article 11 (Cancellation and Refund before Service Commencement)
⦁ Users may cancel the service reservation due to personal circumstances.
⦁ Cancellation process is completed upon the user's notification and Moms Manager's acknowledgment.
⦁ Refund policy for cancellation by the user's fault:
⦁ If cancelled more than 30 days before the scheduled service date, the reservation fee minus 10% is refunded.
⦁ If cancelled less than 30 days to the day of the scheduled service, the reservation fee minus 30% is refunded.
⦁ Moms Manager may cancel the reservation before service commencement by mutual agreement, in which case the full reservation fee is refunded.
⦁ If the service is terminated by the user without the caregiver's fault during the service, 50% of the remaining principal amount is refunded after deduction of the used service time.

Article 12 (Termination and Refund after Service Commencement)
⦁ Either Moms Manager or the user may terminate the service based on Articles 10(2) and 11(1).
⦁ Upon early termination after service commencement, due to the nature of caregiver work and the impact on reservation tasks, the used service amount and a penalty will be calculated for the termination amount.
⦁ If the service is terminated without the caregiver's fault, 50% of the remaining amount after deducting the used service fees is refunded.
⦁ Special care package services are subject to individual charges upon termination and refund.

Article 13 (Package Service Usage)
⦁ When using the massage benefit, receipts are not reissued, and benefits depend on individual coverage and limits.
⦁ For schedule changes in massage services, notification is required one day in advance; cancellation on the day of service results in the deduction of one session.
⦁ For cancellation of massage services, notification is required three days in advance; same-day cancellation results in a 30% deduction from the reservation fee.

Article 14 (Working Hours and Duties of the Caregiver)
⦁ The working hours for commuting caregivers are 09:30-16:00 on weekdays, with Sundays off.
⦁ Live-in caregivers work from Monday 9:00 AM to Friday evening, with Saturday morning off until the next Monday at 9:00 AM.
⦁ Commuting caregivers have a 20-minute break per day, including lunchtime provided by the mother.
⦁ Live-in caregivers have a daily 2-hour break and a weekly 4-hour outing, agreed upon with the user.
⦁ Legal holidays are off unless otherwise agreed for extended work.
⦁ For live-in caregivers, evening duties end at 8 PM, and they sleep after 8 PM with the newborn.

Article 15 (Membership Registration)
⦁ Users can apply for membership by filling in their information on the counseling request form specified by Moms Manager.
⦁ Moms Manager will register the applicant as a member unless:
⦁ The registration contains false, omitted, or incorrect information.
⦁ Registration as a member is deemed significantly disruptive to Moms Manager's operational execution.
⦁ Customers who make reservations via phone call or through an agent will automatically be registered as members.

Article 16 (Protection of Personal Information)
⦁ Moms Manager collects only the minimum necessary information for service provision at the time of user information collection. The following are mandatory, while others are optional:
⦁ Name
⦁ Address
⦁ Phone number (personal or family)
⦁ Information related to childbirth
⦁ Email address
⦁ Provided personal information cannot be used for purposes other than the service or disclosed to third parties without the user's consent, with all responsibility for this borne by Moms Manager

. Exceptions include:
⦁ For statistical compilation, academic research, or market research where information is provided in a way that cannot identify the individual.
⦁ When sharing minimum necessary information among affiliates for member service provision.

Article 17 (Compensation for Loss)
Moms Manager is not liable for the loss or damage of valuables during the service period; please ensure safekeeping.

Article 18 (Disclaimer)
⦁ Moms Manager is not responsible for any accidents or complaints arising from transactions between the user and the postpartum caregiver that are outside the official contract scope (service duration, hours, fees, conditions).
⦁ Moms Manager and the postpartum caregiver diligently fulfill their duties for the health recovery of the mother and the newborn's health enhancement. However, they are not liable for any diseases that occur unless it's due to intentional misconduct or gross negligence by the caregiver.

Article 19 (Copyright and Usage Restrictions)
⦁ Copyright and other intellectual property rights of the works created by Moms Manager belong to Moms Manager.
⦁ Users may not use the information obtained through Moms Manager for commercial purposes or allow third parties to use it without prior consent from Moms Manager.

Article 20 (Dispute Resolution)
⦁ Moms Manager actively handles and attempts to resolve valid complaints or dissatisfaction raised by users.
⦁ Moms Manager may mediate disputes between the user and the postpartum caregiver.
⦁ In cases of theft or loss where the fault cannot be clearly proven by either party, the issue will be referred to the relevant law enforcement authorities for resolution, with necessary information provided for solving the problem.

Article 21 (Insurance)
Moms Manager is not liable for issues arising from the customer's negligence in the context of massage insurance claims.
